Service.

The services we provide.

White Cat Studios provides web design, ecommerce development, SEO and answer-engine optimisation, WordPress builds, managed hosting, care plans, and growth marketing services. Specific services engaged are confirmed per project agreement or invoice.

All services are provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue any service with a minimum of seven days' written notice, except where an emergency or force majeure event makes this impractical.

Pricing, scope, and delivery timelines are confirmed per project before work begins. Estimates provided through the package builder, pricing pages, or individual service pages are indicative starting points and not binding quotes. A formal agreement or invoice constitutes the confirmed scope.

What we need from you.

To allow projects to proceed efficiently, clients are responsible for:

• Providing accurate, complete, and up-to-date information required for the project, including copy, images, brand assets, and any other content needed for the agreed scope.
• Supplying content in a reasonable timeframe. Delays caused by late or incomplete content supply may affect the agreed delivery timeline and are not the responsibility of White Cat Studios.
• Reviewing and providing feedback within agreed review windows. Prolonged review delays may result in the project being rescheduled.
• Maintaining the confidentiality of any login credentials, admin access, or system details provided during or after the project.
• Complying with all applicable laws and regulations in relation to the use of services, including content ownership, data protection, and trading standards.

White Cat Studios is not responsible for errors, delays, or compliance issues that arise from inaccurate, incomplete, or unlawfully provided client content.

Payment terms and refunds.

Payment terms are specified per project in the agreement or invoice. Unless otherwise stated, projects require a deposit before work commences, with the balance due on or before project completion and handover.

Monthly services (including hosting, care plans, SEO retainers, and growth marketing) are billed in advance on a monthly cycle. Continued use of a monthly service constitutes acceptance of the billing cycle.

All fees are non-refundable once work has commenced unless otherwise agreed in writing. Where a project is cancelled by the client after commencement, any work completed to date remains billable at the agreed rate or a fair pro-rata equivalent.

Overdue invoices may result in suspension of active services, including hosting and care plan coverage, until the outstanding balance is resolved.

Ownership of work and materials.

Upon receipt of full and final payment for a project, the client is granted ownership of the final delivered website design and associated deliverables created specifically for that project.

White Cat Studios retains ownership of all underlying frameworks, tools, code libraries, templates, and reusable systems used in the build. These may be used across other projects and are not transferred as part of the project deliverable.

All intellectual property rights in materials, trademarks, and brand assets supplied by the client remain with the client. White Cat Studios will not reproduce, distribute, or use client-supplied materials for any purpose beyond the agreed project scope without prior written consent.

White Cat Studios reserves the right to display completed work in its portfolio, case studies, and marketing materials unless explicitly requested otherwise in writing before project completion.

Revisions and scope changes.

The number of revision rounds included in a project is confirmed at the time of agreement. Revisions are understood to mean reasonable adjustments within the agreed scope, not scope additions, structural changes, or new feature requests.

Changes that fall outside the agreed scope will be assessed and quoted separately. White Cat Studios will not commence out-of-scope work without written confirmation and, where applicable, a revised payment arrangement.

Hosting and ongoing care plans.

Hosting and care plan services are provided on a monthly basis and require a minimum notice period of 30 days for cancellation. Cancellation requests must be submitted in writing to hello@whitecat.co.za.

White Cat Studios will take reasonable measures to maintain uptime, apply updates, and perform agreed maintenance tasks. However, we do not guarantee uninterrupted service and are not liable for downtime caused by third-party hosting infrastructure, software updates, or events outside our control.

Clients are responsible for maintaining backups of any content they wish to retain independently. While White Cat Studios includes backup services in applicable care plans, the ultimate responsibility for critical data lies with the client.

Handling of your information.

White Cat Studios will treat all project information, business details, and communications shared by the client as confidential. This information will not be disclosed to any third party without prior consent, except where required by applicable law.

This obligation of confidentiality continues after the conclusion of the project or service agreement.

Limits on our liability.

White Cat Studios will not be liable for any indirect, incidental, consequential, or punitive damages arising out of the use of, or inability to use, our services, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability for any claim arising from a project or service agreement will not exceed the total fees paid by the client for that specific project or service in the preceding 12-month period.

We do not guarantee specific search rankings, traffic volumes, conversion rates, or commercial outcomes from any service, including SEO, growth marketing, or website design. Results depend on market conditions, client action, and factors outside our control.

Ending the agreement.

Either party may terminate a project or service agreement by providing written notice. The required notice period is confirmed per agreement, typically 30 days for monthly services and as agreed for project-based work.

Termination does not relieve the client of any payment obligations incurred prior to the termination date, including fees for work completed, services rendered, and any third-party costs committed on the client's behalf.

Upon termination of hosting or care services, White Cat Studios will provide reasonable assistance with site migration for a period of up to 14 days, after which access to managed infrastructure may be removed.

Jurisdiction and disputes.

These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or from a service agreement shall be subject to the exclusive jurisdiction of the courts of South Africa.

Where possible, disputes will be addressed first through direct communication. Clients are encouraged to raise concerns with White Cat Studios before escalating to formal legal proceedings.

General provisions.

These terms constitute the entire agreement between the client and White Cat Studios regarding the use of our services, and supersede any prior discussions, representations, or arrangements unless confirmed in writing.

If any provision of these terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

White Cat Studios may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of our services after an update constitutes acceptance of the revised terms.
